This Terms of Service Agreement (the "Agreement") is a legally binding contract between The Run Digital ("we", "our"), operating the Programme SiteWeb Gratuit, and you, whether personally or on behalf of an entity ("you", "the Client"). This Agreement governs your access to and use of our website and services.

1. Acceptance of Terms

By accessing and using our services, you agree to be bound by this Agreement and our Privacy Policy. If you do not accept these terms, you must not access or use our services.

2. Description of the Program

Programme SiteWeb Gratuit Québec is an initiative by The Run Digital designed to support local businesses by providing website design and maintenance services with no initial costs. Clients can choose from four service packages: Basic Hosting, Professional, All-in-One, and Web Dominance, detailed on our pricing page.

Interested individuals can apply for this program through the form available on the homepage. After submitting the form, The Run Digital will send an eligibility confirmation via email, SMS, phone, or a combination of these methods.

3. Subscription and Payment

Billing Cycle: Users will be billed monthly on the same date they subscribed to one of the plans.

Late Payment: Failure to make timely payments may result in service interruption or potential removal of the website.

Cancellation: Subscriptions can be suspended or canceled at any time. Services must be resumed or permanently canceled within one month to avoid website deletion.

Discount Policy:

• Annual Discount: An annual discount is applied to all selected packages, but this discount is not guaranteed permanently. The company reserves the right to remove this discount for future subscription renewals.

• Urgency Discount: When a countdown timer is activated on our website, a discount is generally applied to available packages. If you subscribe to one of these offers during the countdown period, you may benefit from this discount permanently, although the product price may still be subject to change.

4. Project Phase and Revision

• Initial Submission: Clients make a payment, select a service package, and complete an onboarding form to provide all necessary information for website creation.

• Revision Requests: Within five days of submitting the form, clients receive a MarkUp link to request text and image modifications. Clients must submit their revision requests and notify The Run Digital to begin revision work.

• Final Delivery: After revision submissions, we address the requested changes and deliver the final website within seven days of form completion.

5. Intellectual Property

Client Materials: The client retains ownership of their original content, including texts, images, and logos provided for the website creation. However, the website structure, code, and hosting remain under the exclusive management of The Run Digital as long as an active subscription is maintained. The website cannot be transferred to another hosting provider and will no longer be accessible if the client does not maintain their monthly subscription.

Promotional Use: We reserve the right to use any client project in our portfolio and for promotional purposes unless the client submits a specific written request stating otherwise.

6. Prohibited Activities

You may not use our services for illegal or unauthorized purposes. Furthermore, your use of the service must not violate any laws.

7. Changes to the Terms

We reserve the right to modify these terms at any time. All modifications will be published on our website and communicated to clients via email.

8. Termination

Services may be terminated by the client before the 20th of the previous month. We reserve the right to terminate services for violations of these terms or any illegal activity.

9. Ethical and Industry Exclusions

We do not engage with certain industries, including but not limited to:

• Spiritual/religious products or services

• Any music-related activities

• Women's clothing (of any kind)

• Adult content (suggestive or explicit)

• Tattoo parlors

• Aesthetic hair removal services

• Gambling and betting

• Vape shops and tobacco/cannabis products

• Insurance services (of any kind)

• Pork and alcohol-based products

Any business promoting one or more of the restricted elements after the website has been delivered risks entering a conflict zone. The Run Digital reserves the right to modify or remove the promotional element directly from the website. If the issue persists, the client will be considered in a conflict situation.

10. Data Protection Officer (DPO)

Users can request the deletion of their data in accordance with the Privacy Policy. We provide a Data Protection Officer (DPO) to handle data deletion or update requests.

11. Security and Data Storage

We take the security of your data very seriously and implement various measures, including encryption and restricted access, to protect your information.

12. Dispute Resolution

Conflicts will first be attempted to be resolved through direct discussion with the client. If unresolved, disputes will be subject to binding arbitration or legal proceedings under the jurisdiction of Quebec, Canada.

13. Limitation of Liability

We are not responsible for direct, indirect, incidental, or consequential damages resulting from the use of our services.
